Droit et photographie : Loi du 11 mars 1957 sur la propriété artistique.
Tout photographe (aussi bien amateur que professionnel !) jouit sur son oeuvre d’un droit absolu, “perpétuel, inaliénable et imprescriptible”.
Ce droit moral recouvre :
Le Droit de Divulgation : l’auteur est libre de soumettre ou non son oeuvre à ses contemporains, sous son nom, pseudonyme, ou de façon anonyme.
S’il décide de la signer, les organismes assurant la divulgation matérielle de l’oeuvre, à titre onéreux ou gratuit, sont dans l’obligation de mentionner sa signature.
L’absence de cette signature constitue une violation flagrante du Droit moral, au même titre que l’usurpation de cette oeuvre par un tiers.
Personne ne peut s’arroger le droit d’effacer la signature de l’auteur sur son oeuvre.
Le Droit de Respect de l’oeuvre : assure l’intégrité de l’oeuvre telle que l’auteur l’a voulue. Personne ne peut s’arroger le droit de la modifier, par exemple en la reproduisant par fragments.
Le Droit de Repentir : il est toujours possible à l’auteur, le cas échéant contre dédommagement de l’organisme utilisateur de l’oeuvre, de retirer celle-ci de l’exploitation qui en est faite.
